4. Cancellation and Refunds

Customer-initiated cancellations must be made in writing. Deposits may be non-refundable if materials have been ordered or work has commenced. Cancellation fees may apply based on work completed and costs incurred. Specific cancellation terms will be outlined in your contract.

5. Warranties

We stand behind the quality of our workmanship. Warranty terms for labor and materials will be specified in your contract. Manufacturer warranties on materials are passed through to the customer and are subject to the manufacturer's terms and conditions. Warranties do not cover damage caused by acts of God, accidents, misuse, or lack of proper maintenance.

6. Insurance and Liability

Utah Roof Consulting carries appropriate liability insurance. We are not responsible for damage to underground utilities, landscaping, or other items not directly related to the roofing work unless caused by our gross negligence. Customers are responsible for removing or protecting personal property in and around work areas.

7. Access to Property

By engaging our services, you grant us permission to access your property as necessary to complete the work. You agree to provide clear access to the work area and to secure any pets during our visits.

8. Communication and SMS Text Messaging

Communication Methods:

We may communicate with you via phone, email, text message (SMS), or mail regarding your project, appointments, and our services.

SMS Text Messaging Terms:

By providing your mobile phone number and consenting to receive text messages, you agree to receive SMS messages from Utah Roof Consulting, including but not limited to:

• Appointment reminders and confirmations

• Project updates and service notifications

• Marketing messages and promotional offers (if you opt in separately)

Consent and Opt-In:

Your consent to receive SMS messages is not a condition of purchasing services from us. You may choose to receive services without opting in to SMS communications. Marketing messages require separate explicit consent.

Message Frequency:

Message frequency varies. You may receive appointment reminders before scheduled visits, project updates during active work, and periodic marketing messages if you have opted in.

Message and data rates may apply. Standard charges from your mobile carrier will apply to SMS messages sent and received.

Opt-Out:

You may opt out of receiving SMS messages at any time by texting "STOP" to any message from us. After opting out, you will receive one confirmation message. You may also contact us directly to be removed from our SMS list. Opting out of SMS will not affect your ability to receive our services.

9. Changes to Schedule

We will make every effort to complete work on schedule. However, delays may occur due to weather, material availability, permit issues, or unforeseen circumstances. We will notify you promptly of any significant delays. Customer-requested schedule changes must be made at least 24 hours in advance when possible.

10. Permits and Compliance

When required, we will obtain necessary building permits for the work. Permit costs may be included in the contract price or billed separately. Customers are responsible for ensuring that any homeowner association (HOA) approvals are obtained prior to work beginning.

11. Dispute Resolution

Any disputes arising from these Terms or our services will be resolved first through good-faith negotiation. If negotiation is unsuccessful, disputes will be resolved through binding arbitration in Weber County, Utah, in accordance with Utah law. Each party will bear its own costs and attorney's fees unless otherwise awarded by the arbitrator.

12. Limitation of Liability

To the fullest extent permitted by law, Utah Roof Consulting's total liability for any claims arising from our services shall not exceed the total amount paid by the customer for the specific project in question. We are not liable for indirect, incidental, consequential, or punitive damages.

13. Indemnification

Customer agrees to indemnify and hold harmless Utah Roof Consulting from any claims, damages, or expenses arising from customer's failure to disclose material information, interference with work, or violation of these Terms.

14. Intellectual Property

All materials, designs, estimates, and documentation provided by Utah Roof Consulting remain our property. Customers may not reproduce or distribute these materials without our written permission.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Your continued use of our services after changes are posted constitutes acceptance of the modified Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with any written contract or estimate, constitute the entire agreement between you and Utah Roof Consulting regarding our services and supersede all prior communications and agreements.

18. Governing Law

These Terms are governed by the laws of the State of Utah without regard to conflict of law principles.
